현직 판사가 6일 인터넷 포털사이트에 이른바 판사 블랙리스트 의혹 재조사를 요구하며 국민 청원운동을 시작한다는 글을 올려 논란이 되고 있다.
이 의혹은 법원행정처 간부로부터 판사 모임인 국제인권법연구회 주최 세미나를 축소하라는 지시를 받은 이모(39) 판사가 법원 진상조사위원회 조사를 받으면서 "행정처 컴퓨터에 비밀번호가 걸린 판사 뒷조사 파일이 있다고 들었다"고 말하면서 불거졌다. 하지만 진상조사위와 대법원 공직자윤리위원회는 '사실무근'으로 결론지었다. 지난달 19일 전국법관대표회의는 자신들이 직접 의혹을 조사하겠다며 조사권을 달라고 했으나 양승태 대법원장은 "중립적으로 구성된 조사위가 결론을 내렸다"며 수용하지 않았다.
차성안(40) 전주지법 군산지원 판사는 이날 포털사이트 다음의 이슈 청원 코너에 '판사 블랙리스트 의혹에 대한 관심을 청원합니다'라는 제목의 글을 올렸다. 법관대표회의가 2차 회의를 여는 24일까지 10만명으로부터 서명을 받겠다는 취지로 작성된 글이었다. 차 판사는 글에서 '얼마 전 대법원장은 법관대표회의가 요구한 판사 블랙리스트 의혹 추가 조사를 거부했다'며 '사법부 자정 노력이 수포로 돌아가는구나 하는 답답한 마음에 제가 직접 시민들에게 관심을 호소하기로 결심했다'고 썼다. 6일 오후 9시 현재 약 3400명의 사이트 방문자가 차 판사의 '국민 청원운동' 주장에 찬성했다. 차 판사는 국제인권법연구회 회원이고 법관대표회의 참석자다.

필자는 지난 6월 5일자 본란에 여론조사가 전체 국민의 여론조사인양 숫자놀음을 하는 것을 정치인들이 이를 근거로 발언과 행동을 하며 대통령이 인사와 정책을 추진하는 것을 경계하기 위하여 “여론기관의 숫자놀음과 국민을 현혹하는 숫자의 마술”이란 제목으로 토론 글을 올렸는데 다음 글은 그 요점을 정리한 것이다.
전 국민의 0.00001%가 응답한 여론조사결과가 74%로 둔갑을 하고, 0.00002%가 응답한 여론조사결과가 88%로 둔갑을 하니 이게 바로 국민을 현혹하고 오도하는 것이요, 당사자인 이낙연과 문재인의 가슴을 뿌듯하고 행복하며 즐겁고 기분 좋으며 큰소리치게 해주는 소위 숫자의 마술(魔術)이라는 것이다.

죽엽석고탕 竹葉石膏湯
【製法用量】
竹葉15克(2把) 石膏30克(1斤) 半夏洗9克(半升) 麥冬去心15克(5兩) 人參6克(2兩) 甘草炙6克(2兩) 粳米15克(半升)
上七味，用水1升，煮取600毫升，去滓，納粳米，煮米熟，湯成，去米，溫服200毫升，日三服。
【功效】
清熱生津，益氣和胃。
【主治】
1.熱病後期，餘熱未清、氣津兩傷。嘔逆煩渴、口乾唇燥喉乾嗆咳、心胸煩悶、或虛煩不得眠、舌紅少苔、脈虛數。
2.暑熱證、氣津兩傷。身熱多汗、虛贏少氣、煩渴喜飲、舌紅，脈虛數。
1. 열병을 앓고 난 뒤에, 아직 열이 다 청산되지 않고, 氣津이 모두 상한 상태에서, 구역질과 번갈煩渴, 입과 입술이 마르고, 인후 역시 마르고 기침을 하며口乾唇燥喉乾嗆咳、심흉번민心胸煩悶、허번에 의한 불면虛煩不得眠、설홍에 설태는 별로 없을 때舌紅少苔, 이 방제를 쓴다.
2. 기진이 모두 상한 서열증에도 쓴다. 暑熱證、氣津兩傷
【方義】
本方是由白虎湯衍化而來的。白虎湯證為正盛邪實，本方證為大熱已衰、餘熱未清，而氣津兩傷。方中竹葉、石膏清熱除煩以祛熱邪為君；人參麥冬益氣生津以補正虛為臣；半夏和逆止嘔，其性雖溫但與清熱生津之藥配伍、則溫燥之性去而降逆之用存，且能轉輸津液、恢復脾運、並行人參、麥冬之滯而調和胃氣為佐；甘草、粳米調養胃氣為使也。諸藥合用、既能清未盡之餘熱、又可補已耗之氣陰、邪正兼顧、為一清補之劑。凡熱病過程中、發熱不退、氣陰兩傷之證皆可使用。
【辨證要點】
1.身熱多汗。
2.口乾少氣。
3.舌紅少苔。
4.脈虛數。
【加減】
1.口渴甚：加天花粉、生地、石斛。
2.熱甚：加重石膏或加銀花、連翹、黃芩。
3.汗多：加白朮。
4.氣虛明顯者：加黃耆。
5.血虛明顯者：加當歸、熟地。
6.肺炎喘咳：加麻黃、杏仁、黃芩、魚腥草。
7.痰多：加貝母、橘皮。
죽엽석고탕은 열병 후의 조리방이다. 열병 후에 환자가 마르고 저열低熱이 계속될 때, 이 방제를 쓸 수 있다.
「竹葉石膏湯」可應用於「熱證」治療。南京中醫藥大學教授黃煌在一場研討會中表示，竹葉石膏湯是常用的熱病後期的調理方，有清熱養陰的功效，適用於發熱性疾病以及體質瘦弱者的長期低熱、久咳、食欲不振、多汗等。
黃煌表示，竹葉石膏湯的經典配方包括有竹葉、石膏、半夏、麥門冬、人參、甘草、炙粳米共七味。經典方證中提到，「傷寒解後，虛羸少氣，氣逆欲吐，竹葉石膏湯主之」。
黃教授表示，其中，所謂的「虛羸少氣」；虛羸是指形體消瘦。在《傷寒論》提到，此方主治是「傷寒解後」，可知本方的經典用法主要針對「熱性病的恢復期」，餘熱未盡兼有津傷。此時，患者可能不發熱，也可能表現多為「低熱」。但患者大部分都表現為消瘦和虛弱，過去常用「骨瘦如柴」「形銷骨立」等來描述。
而「少氣」，是指氣短、乏力；氣逆欲吐者，是指咳嗽、乾嘔。往往咳則痰涎膠著難去，或張口抬肩，或咽喉枯燥不適。

徐某:男，69歲，肺癌術後15天，嘔惡納差，少氣懶言，肢倦乏力，自覺身熱（體溫37.8度），口咽干，心煩寐差，小便黃，大便難，下之硬。經輸液治療，效不顯。檢查：患者形體消瘦，精神不振，面黃少澤，舌紅津少，脈虛數。
【症屬】氣虛陰虧，津液不足，胃氣不和。
【治宜】益氣養陰，清熱生津，和胃降逆。
【方藥】竹葉石膏湯加味：竹葉10克，石膏15克，姜半夏10克，陳皮10克，麥門冬15，太子參30克，石斛10克，玉竹10克，百合15克，甘草10克，粳米50克。水煎服，日1劑。服7劑後，納食漸增，口咽干減輕。守方續服7劑，嘔惡止，身熱輕，（體溫36.5度）。仍氣短乏力，原方加炙黃芪30克，服7劑後，自感身體有了力氣，夜寐安，心煩除。大便軟，次數多，減石膏，加炒山藥30克。服7劑，發熱愈。
按:竹葉石膏湯中，竹葉清熱除煩，半夏和胃降逆止嘔，妙在以辛溫之半夏與寒涼滋潤之石膏、麥冬相配，一則使石膏涼潤而不呆滯，再則使半夏降逆而不溫燥，以潤制燥，使得補而不膩，於清熱養陰，和胃降逆方中用此最宜，人參益氣生津，因人參性溫，臨床多用太子參代，太子參性平，屬補氣藥中的清補之品，粳米、甘草養胃和中，又可使寒涼清泄而不傷中氣。本方清補兼施，邪熱與氣陰兼顧，清熱而兼和胃、補虛而不戀邪，謹守病機，靈活化裁，治療胃虛有熱，效果顯著。

【常用劑量】竹葉15g，生石膏30g，制半夏10g，麥門冬30g，西洋參10g或生曬參10g，生甘草10g，粳米30g或山藥30g。
【煎服法】以水1200ml，煮沸後調文火再煎煮40分鍾，取湯液300ml，分2～3次溫服。
【經典方證】傷寒解後，虛羸少氣，氣逆欲吐。（397）
【體質要求】消瘦和虛弱，語言低微，前人常用“虛羸少氣”、“骨瘦如柴”、“形瘦骨立”等來描述。或乾咳，或氣喘，或乾嘔，或呃逆，或盜汗，大多食欲不振，大便乾結，煩躁口渴等。舌多嫩紅少苔，脈象細軟無力。
【適用疾病】發熱性疾病的恢復期低熱、急性脊髓炎、小兒夏季厭食低熱、瘦弱體質的肺炎、瘦人反復發作的口腔潰瘍、腫瘤放療化療後的低熱口乾及舌燥、多汗症等。
【加減法】腫瘤後消瘦貧血，合炙甘草湯；出血，加阿膠、地黃。
【注意事項】舌淡，大便不成形者慎用。

Re: Please Help Save President Geun-Hye Park of South Korea
Dear Mr. President,
We represent the People of Korea (“Clients”) who are residing in the Korean peninsula and elsewhere in the world including the ones residing in the US. We are lawyers in the US running a non-profit public benefit corporation based in California providing pro-bono professional international legal services to the people of various countries with legal issues arising from troubled judicial systems.
On this occasion, we are requested by the Clients to advise you of the recent demise of the judicial system in South Korea relative to the manipulated ousting of incumbent President, Geun-Hye Park, and false imprisonment and unlawful prosecution, all against the Constitution and in violation of human rights. We are further requested by the Clients to seek cooperation of your excellency in having her released from the rebellions’ custody and transferring her to the US territory for medical treatment and possible political asylum.
In support of our petition to you of a decisive emergency measure to ensure the safeguard of her person, we present the following as the circumstantial evidence, which we will augment and substantiate further upon direction.
1. President Park was unlawfully ousted by false and fake press gate, coupled with the National Assembly political corruption and treason, and finally a fraudulently misleading judgment of the Constitutional Court, sentencing her to removal from office based on the Court’s arbitrary cause of action, while it de facto dismissed all causes of action petitioned by the National Assembly, which had exclusive subject matter jurisdiction for impeachment of President. Discharge of President, however, is permitted only when there is a valid cause of action stated by the National Assembly (Constitution Court Law Section 53(1)). Without quoting the impeachment petition (thereby holding one of the causes of action validly stated), the Court is not empowered to sentence dismissal of President.
2. Despite that President Park should have been duly reinstated as of March 10, 2017, as the result of failed impeachment and illegal sentence of removal, both sovereign police power and judicial tribunals were inoperable due to firm seizure by the indoctrinated terrorists. President Park was arrested and indicted for bribery and other minor crimes, directly in violation of criminal immunity provision (Section 84) of the Constitution.
3. Anomaly ensued. Vacancy election notice, which had been given earlier for possible Presidential vacancy, was not revoked. People were driven to the election syndrome and led to vote for the ‘next term’ President, the 20th, that is, and not for the vacancy, which would be from May 9, 2017 to February of 2018. As the result, legally speaking, the election was invalid and unenforceable.
4. The process of election, however, was no exception to historical corruptive voting procedure. Several law suits were filed and are pending. President-elect went ahead to inaugurate himself for the term of 5 years, without formal inauguration procedure with due recognition by neighboring nations. Lack of authority in mind, Clients have serious doubt on his capability to manage the country.
5. Currently, President Park, legally incumbent but in fact captive in hostage as if a war criminal, is being interrogated severely and mentally tortured by unlawful means of life threatening courtroom proceedings; over 10 hours each day, 4 days a week. She finds herself in sporadic comas and suffers from starvation and malnutrition; manifesting symptoms of several life-threatening diseases. No doctors and treatments are offered. No stopping of the court proceeding is forecasted. She must quickly be transferred to the US or its military compounds in Korea, especially, if and when any type of war breaks, as she will be the priority target by the North as they have avowed recently.
We are prepared to apply for her asylum under US immigrations law once she is released and transported to the US. We re-confirm that she is the symbol of national sovereignty of Korea by far better than anyone on earth.
Therefore, we hereby respectfully and cordially request your highest attention to the survival of the President Park. It will be most grateful if you will proactively act upon our request in no time to save her life. It is the only hope of the entire Korean peninsula, that you as the supreme commander of the 70 years’ faithful ally will save the life of President Park, and thereby save many lives of the entire peninsula.
